1. GENERAL
1.1 Ikigaiya, with registered address at Oude Diestsestraat 9, 3473 Kortenaken and company number BE0789397975, complies with the "Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data", as amended by the Act of 11 December 1998, as well as the anti-spam provisions of Book XII of the Code of Economic Law concerning the "law of the electronic economy".
1.2 Ikigaiya also aligns itself, through this privacy policy, with European Regulation 2016/679 of 27 April 2016 on the protection of personal data.
2. PERSONAL DATA
2.1 Personal data you provide to us:
- Category 1, without registration: your IP address, browsing behaviour, origin, and search terms
- Category 2: your profile name, password, email address, login details
- Category 3: upon registration / newsletter sign-up: your email address
- Category 4: via cookies
- Category 5: your address details when placing an order
2.2 Ikigaiya may collect data from you in different ways:
- Through the use of cookies (see below)
- During your registration and use of the website

3. PURPOSES OF PROCESSING
3.1 General purposes
Ikigaiya will use the personal data collected from you exclusively for the following purposes:
- Category 1: maintaining and improving this website and including personal data in anonymous statistics from which the identity of specific individuals or companies cannot be determined — legal basis: the legitimate interests of Ikigaiya to continuously improve its website and services.
- Category 2: managing your account on this website for use of our company and website — legal basis: the performance of an agreement requested by you; and, if indicated by you, also sending direct marketing — legal basis: your explicit, prior consent.
- Category 3: sending you direct marketing, newsletters, promotions and offers — legal basis: your explicit, prior consent.
- Category 4: (purposes of cookies) — legal basis: your explicit, prior consent.
- Category 5: delivery and invoicing of products ordered by you — legal basis: the provision of a service requested by you. You are not obliged to provide your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing.
3.2 Direct marketing
Personal data will also be used for direct marketing, provided you have given additional explicit consent ("opt-in"). If you are already included in our mailing list for receiving marketing material in paper and/or electronic form, Ikigaiya may use your data to send marketing and other material relating to Ikigaiya, its products and/or services. Ikigaiya may use the data you provide to update documents held by Ikigaiya.
3.3 Transfer to third parties
In the event of a full or partial reorganisation or transfer of activities of Ikigaiya — whereby it reorganises, transfers or ceases its business activities, or in the event of Ikigaiya going bankrupt — this may mean that your data is transferred to new entities or third parties through which the business activities of Ikigaiya are carried out in whole or in part. Ikigaiya will make reasonable efforts to notify you in advance that it is disclosing your data to said third party, but you also acknowledge that this is not technically or commercially feasible under all circumstances. Ikigaiya will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described above or unless with your prior consent.
3.4 Legal requirements
In rare cases, it may occur that Ikigaiya must disclose your personal data pursuant to a court order or to comply with other mandatory laws or regulations. Ikigaiya will make reasonable efforts to inform you in advance, unless such notification is subject to legal restrictions.
4. DURATION OF PROCESSING
4.1 Personal data is retained and processed by us for a period necessary in relation to the purposes of processing and in relation to the contractual relationship between the company and you. Personal data will be deleted when it is no longer needed to pursue these purposes, or if you validly exercise your right to erasure.
4.2 The following retention periods apply per processing purpose:
- Inactive customer accounts are deleted after 2 years of inactivity.
- Invoice, payment, and order data are retained for legal reasons for a minimum of 10 years after the last invoice date.
- Newsletter subscriber data is retained until the subscriber unsubscribes.
- Support and contact messages are deleted 6 months after the matter has been resolved.
- Cookie and analytics data is retained for the duration specified in our cookie policy.
5. YOUR RIGHTS
5.1 Right of access and inspection
You have the right to access your personal data free of charge at any time, as well as information about how we use your personal data.
5.2 Right of rectification, erasure, and restriction
You are free to choose whether or not to provide your personal data to Ikigaiya. You also always have the right to request that we rectify, supplement, or delete your personal data.
You acknowledge that if you refuse to provide or request the deletion of personal data, certain services and products may not be deliverable. You may also request that the processing of your personal data be restricted.
5.3 Right to object
You also have the right to object to the processing of your personal data for serious and legitimate reasons. In addition, you always have the right to object to the use of your personal data for direct marketing purposes; in such a case you do not need to provide reasons.
5.4 Right to data portability
You have the right to obtain the personal data processed by us in a structured, commonly used, and machine-readable format, and/or to transfer it to other data controllers.
5.5 Right to withdraw consent

This is without prejudice to a remedy before a civil court. If you suffer damage as a result of the processing of your personal data, you may bring a claim for compensation.
6. SECURITY AND CONFIDENTIALITY
6.1 We have developed technical and organisational security measures to prevent the destruction, loss, falsification, alteration, unauthorised access, or accidental disclosure to third parties of collected personal data, as well as any other unauthorised processing of such data.
6.2 Under no circumstances can Ikigaiya be held liable for any direct or indirect damage resulting from incorrect or unlawful use of personal data by a third party.
6.3 You must at all times comply with the security guidelines, including by preventing any unauthorised access to your login and password. You are therefore solely responsible for the use made from the website via your computer, IP address, and identification data, as well as for their confidentiality.
7. ACCESS BY THIRD PARTIES
7.1 In order to process your personal data, we grant access to your personal data to our employees.
7.2 We guarantee a similar level of protection by making contractual obligations enforceable against these employees and agents, which are equivalent to this privacy policy.
7.3 The following third parties (processors) also have access:
- Shopify: Hosting and management of the webshop and customer data.
- MyParcel: Generation of shipping labels and delivery.
